The online store www.marcette.com (hereafter referred to as the "site") is hosted on Shopify Inc which provides the e-commerce platform.


The Internet customer is referred to as the Customer.


Access and use of the Site are reserved for individuals, adults. In all cases, the access or use of the Site, by a Customer, brings express and unreserved acceptance of the present Terms of Sale and Use of the MARCETTE website (hereafter the "General Terms of Sale and Use").

The Site offers decorative items for sale. Products can only be delivered in Metropolitan France. If you want to be delivered to another country you should contact Berenice via this email address: berenice@marcette.com to see together the delivery methods.

These Terms and Conditions of Sale and Use may be amended at any time, with the understanding that each Order on the Site is governed by the Terms and Conditions of Sale and Use in effect on the date of the Order.

Any Order is worth accepting these Terms and Conditions of Sale and Use, the price and description of the Products objects of the Order.


All new features and tools that will be added to this store at a later date will also be subject to these General Terms of Sale and Use.

MARCETTE reserves the right to update, change or replace any part of these General Terms of Sale and Use by publishing updates and/or changes on this website.

The products or services offered are available in very limited quantities and can only be returned or exchanged in accordance with our Return Policy.

The MARCETTE Site has done its best to display as clearly as possible the colors and images of the products that appear on the shop. The photographs that show the objects offered for sale are intended to be as faithful as possible but therefore have no contractual value. MARCETTE also cannot guarantee that the display of colors by your computer screen will be accurate.

 

1. Acceptance of these terms and conditions of sale and use

By logging on to the site, a Customer who wishes to place an order for a Product acknowledges that he has read the present Terms of Sale and Use and agrees to be bound to them for the purchases of products that he will make in this context by any means.

Products offered on the site are described in Product listings containing one or more photos and indicating their name and characteristic.

The Customer acknowledges and accepts that the photographs may have variations with the product that will be delivered to him. Indeed, some products being handcrafted photographs and images illustrating the site are only indicative and are not contractual.

By visiting this site and/or by purchasing one of our products, you agree to be bound by these terms and conditions. These General Terms of Sale and Use apply to all users of this site.

 

2. Access to the site

MARCETTE strives to provide permanent access to the Site, 24 hours a day, 7 days a week. However, access to the site may be suspended at any time and without notice, including due to outages, network, system and/or communication failures, as well as maintenance and corrections made necessary by the site's updating and proper operation.

MARCETTE also reserves the right to make, at any time, any modificationdeletions, deletions and/or additions to the content of this site, without notice and on a discretionary basis. The Client undertakes not to interfere with access to the site and/or the proper functioning of the site in any way, which may damage, intercept, interfere with all or part of the site. 3. Processing personal data

The lack of information automatically results in the order not being validated. In accordance with the Computer, Files and Freedoms Act, the Customer has at all times an individual right to access, modify, correct and delete data about him. 4. Authentication and security

When the necessary conditions for registration are met, and subject to the acceptance of MARCETTE, the Customer can, through his identifiers, access and manage his Client Account and place orders. These identifiers are strictly personal and confidential and should not be shared or shared with third parties. Under no circumstances can MARCETTE be responsible for the loss of its identifiers by the Customer.


5. Order

Automatic registration systems are considered to be worth proof of the nature, content and date of the order.

MARCETTE will confirm to the customer the acceptance of his order by sending a confirmation message to the email address that the customer has communicated. The sale will not be concluded until the order confirmation is sent out.

MARCETTE reserves the right to refuse or cancel any order from a customer, especially in the event of the customer's insolvency or in the event of a default on the order concerned or a previous delivery or a dispute over the payment of a previous order.

The mentions indicated by the customer, when entering the information inherent in his Order, engage the latter. MARCETTE cannot be held responsible for the errors made by the customer in the wording of the contact information of the recipient of the Order (delivery address, billing address in particular) and for delays in delivery or the inability to deliver the ordered products that these errors could cause.

Product inventories are kept up to date in real time. However, despite the precautions taken, stock and/or supply shortages are possible. In this case, the Site informs the Customer and agrees, at the Customer's choice, to reimburse him the amount paid or to offer him an equivalent or higher product in quality and price. The site reserves the right to refuse an Order, even if it has been confirmed automatically, if the receiving country is not Metropolitan France or Corsica.


6. Suspension-errors and inaccuracies

It may be that there is sometimes information on our site that could contain typographical errors, inaccuraciesor omissions that may be related to product descriptions, prices, promotions, offers, product shipping costs, delivery times and availability. We reserve the right to correct any errors, inaccuracies, omissions, and to change or update information or cancel orders, if any information in the Service or on any other associated website is inaccurate at any time and without notice (including after you have placed your order).

 

7. Price, invoice

The overall price shown in the site order confirmation is the final price. The price is expressed in euros and all taxes included. The value-added tax is the one in effect in France at the time of the order. Delivery fees are paid. The payment of the products is by bank card (Eurocard, Visa, Blue Card, Mastercard) or Paypal. The debit on the customer's bank card or Paypal account will be made in euros only.


8. Delivery

Products can only be delivered in Metropolitan France, Corsica (for other European countries you should contact berenice: berenice@marcette.com), at the address informed by the Customer during the handing over of the order.

The customer undertakes to pay on receipt all taxes, duties, taxes and other charges present and future due in connection with the delivery of those products themselves; MARCETTE's joint and several liability cannot at any time be incurred in this capacity.

Upon receipt of the ordered products, the customer or recipient will have to check the condition and the proper functioning of the product. He will also be aware of his conditions of employment on the instructions for use provided to him, if present.

In the event that one or more of the products ordered are missing or deteriorated, the customer or recipient must make any reservations with the carrier at the time of delivery (for more information see Chapter 11 - Reserves when receiving the products).

In the event of apparent defects, the customer has the right of return under the conditions stipulated in the notice of use of the property.

For reasons of availability of the ordered products, an Order may be the subject of several successive deliveries to the customer.

In the event that the customer wishes the products ordered to be delivered to two separate addresses, it will be appropriate for the customer to place 2 separate orders.

 

9. Transfer of Ownership and Risks

The transfer of ownership and the transfer of risks take place as soon as the Customer enters possession of his Products.


10. Retraction and claim

The customer has 14 days from the receipt of the products ordered to return them to MARCETTE for exchange or refund. In this case, the customer will have to return the Products in their packaging to their original condition, along with all possible accessories, instructions for use and documentation to the following address:

In the absence of reservations expressly issued during delivery, the Products are deemed to be compliant with the Order. To exercise this right of claim, the Customer has 7 days to send MARCETTE, at: berenice@marcette.com, a declaration ofwhich it expresses its reservations and claims, with the supporting documents (reception slip countersigned by the carrier, photographs...).

A claim that does not meet the conditions described above cannot be accepted. MARCETTE will repair, replace or refund the Product or its components as soon as possible and at its own expense, subject to the material possibility of repairing the Product or its availability in stock.

If the right of withdrawal is exercised, the Client has a right of withdrawal of 14 days from the time the Order is placed. To exercise this right of withdrawal, the Customer sends a statement to: berenice@marcette.com. Products must be returned in their original packaging and in perfect condition within 7 days of notification of the customer's withdrawal to MARCETTE. The direct costs of referral remain at the Customer's expense. He will be reimbursed for the full cost paid for the handing over of the Order deducted from the delivery costs (sending and return) that remain at the Customer's expense, within 14 days of MARCETTE's knowledge of his retraction statement. The refund will be made by the same means of payment as the one used to purchase.

 

11. Reserves at the receipt of the Products

In the event of reservations, the Customer must, as far as possible, issue these reservations when the Products are delivered, in writing to the carrier and send a copy of these reservations by e-mail to the following address berenice@marcette.com as soon as possible and provide with this shipment confirmation by the carrier of the reality of these reserves.

 

12. Limitation of liability

MARCETTE cannot be held responsible for any damage of any kind, whether material, immaterial or bodily, that could result from malfunction or misuse of the products marketed.

MARCETTE's liability will, in any event, be limited to the amount of the order. In the event of difficulties in the application of this contract, the client and MARCETTE reserve the possibility, before any legal action, to seek an amicable solution.


13. Customer Service

14. Comments, suggestions and other suggestions for use

These Terms and Conditions of Sale and Use are governed exclusively by French law, excluding any other right or convention, regardless of where it is used. This is the case for substantive rules as well as for rules of form.
